1.	These General Terms and Conditions (“GTC”) form an integral part of the contract between Motor Presse Stuttgart GmbH & Co. KG, Leuschnerstr. 1, 70174 Stuttgart, DE ("organiser") and the purchaser ("End Customer") of access, participation, admission or visitor authorisations, reservations or vouchers for these rights, or similar or related rights ("Tickets"), or other offers, products or services (e.g. merchandise) ("Offers") distributed by organiser via services operated by vivo. End customers as defined herein also include individuals who have not purchased tickets or other offers directly from the organiser, but who are entitled to participate in an event (e.g. through a secondary purchase, if permitted).

2.	All communication with the organiser should be addressed to: Motor Presse Stuttgart GmbH & Co. KG, Leuschnerstr. 1, 70174 Stuttgart, Germany or datenschutz@motorpresse.de.

3.	vivenu GmbH (Völklinger Straße 33, 40221 Düsseldorf, Germany) and its affiliated companies (together, "vivenu") provide software and other services (the "vivenu Services") that enable providers or operators of artistic, cultural, sporting or other performances, plays, concerts, meetings, seminars, leisure facilities, museums, sites, film screenings, operas, readings, trade fairs, conferences, further education/training events, courses and other events and performances (whether physical or virtual) ("event") to distribute tickets and other offers, and to process related transactions with end customers. vivenu provides a technology platform for event organisers and is not a ticket broker or the organiser of an event.

1.	Upon Upon successfully completing a purchase transaction via vivenu services, a contract is formed exclusively between the organiser and the end customer. This also applies if tickets or other offers are marked with additions such as “powered by vivenu” or similar, or if the organiser advertises, offers, and distributes the tickets or other offers via the domains and subdomains of vivenu (e.g. vivenu.com). No purchase, service, or other contracts are concluded between the end customer and vivenu regarding the purchase of tickets and the event-related services.

2.	The end customer is not entitled to enter into a contract with an event organiser. The end customer acknowledges that the event organiser may make the conclusion of the contract dependent on their acceptance of additional conditions, data protection declarations, cancellation policies and other contractual components, as well as further restrictions (e.g. a maximum ticket limit for an event). The event organiser and vivenu (acting on behalf of the event organiser) may refuse or reject purchase transactions with an end customer without providing reasons.

3.	The end customer acknowledges that the total purchase price of a transaction is determined solely by the organiser, who may change it at any time. This total may exceed the ticket price shown on the ticket or in the ticket shop. This total is calculated by adding any fees and taxes to the ticket price shown. The total purchase price to be paid by the end customer will be communicated before the order process is completed. Payment of the total purchase price can only be made using the payment methods provided by the organiser or vivenu (acting on behalf of the organiser).

4.	The contract between the organiser and the end customer is only concluded when vivenu (acting on behalf of the organiser) sends the end customer the relevant confirmation (e.g. by sending the transaction confirmation and then the ticket with the corresponding ticket ID). Simply completing the order process does not constitute the conclusion of a contract, nor does it entitle the end customer to participate in an event.

5.	If technical problems result in the total ticket quota for the event or the quota for individual ticket categories being exceeded, the organiser or vivenu (acting on behalf of the organiser) shall inform the end customer. The organiser or vivenu (acting on behalf of the organiser) may cancel the relevant tickets and refund the total purchase price already paid.

Unless the organiser or Vivenu (acting on behalf of the organiser) communicates otherwise, the end customer will receive an automatic email from vivenu (acting on behalf of the organiser) confirming the order, as well as another email containing a link to the purchased tickets for the corresponding event. The type of ticket provided depends on the admission method used by the organiser for a particular event, and this will be communicated to the end customer (e.g. download and print, digital wallet, etc.). To participate in an event, the ticket must be presented in the communicated form. Simply presenting the order confirmation email does not entitle the holder to participate in an event.

2.	If the organiser provides this option, the end customer can order printed tickets that are posted to them for a fee (“hard tickets”).

3.	Upon delivery or receipt, the end customer must check that the ticket is accurate in terms of number, price, date, event, venue and other essential features. Any complaints regarding incorrect tickets must be made immediately and in any case within seven working days of delivery or receipt, to the organiser or vivenu (acting on behalf of the organiser). Statutory warranty rights remain unaffected.

4.	Ownership of tickets, or any rights derived from them, is only transferred to the end customer once the total purchase price has been paid in full, or all outstanding claims have been settled.

5.	During the purchase process, the end customer must provide truthful, complete and accurate information. The organiser or vivenu (acting on behalf of the organiser) may verify the end customer's information using appropriate means (e.g. a credit check).

All information relevant to an event or other offer from the organiser, such as the scope/content, location, time, organiser, price, fees and taxes, participation requirements and restrictions, access controls and restrictions, the type of tickets to be presented, accessibility, the seating plan, house rules and other rules of conduct for the respective event venue, and any other restrictions or essential information that could reasonably influence an end customer's purchase decision, shall be communicated by the organiser or vivenu (on behalf of the organiser).

2.	The end customer hereby acknowledges this information and these regulations, which form an integral part of the contract between the organiser and the end customer.

3.	It is the sole responsibility of the end customer to check whether they can fulfil the requirements, conditions and provisions necessary for participation, and whether they wish to do so. In the event of non-compliance or non-observance, the organiser may refuse or terminate participation in or attendance at an event.

4.	In the event of a proven violation of legal provisions, these General Terms and Conditions, or other provisions or requirements of the organiser (e.g. fraudulent, illegal or dishonest activities), or attempts to circumvent these provisions, the organiser or vivenu (acting on behalf of the organiser) may invalidate a ticket before or during an event, and deny the end customer the right to participate in the event or remove them from it.

5.	Damage, loss or seizure of tickets must be reported to the organiser and vivenu by the end customer without delay. If the end customer loses a hard ticket or it is lost within their area of responsibility, the organiser or vivenu is not obliged to provide a replacement.

6.	Unless otherwise agreed, a ticket is only valid for the respective event (in particular in terms of location and time), and if applicable, for the respective seat, seating unit or ticket category. The ticket loses its validity once the event has taken place.

7.	The end customer acknowledges that the organiser is solely responsible for events and other offers provided by the organiser via vivenu services, including their content, quality, schedule, implementation, modification, termination, cancellation or postponement, as well as the corresponding communication, publications and information. vivenu bears no responsibility for this in any way. vivenu has no obligation to instruct, check or supervise the organiser with regard to their obligations towards end customers. Furthermore, vivenu is under no obligation to verify the organiser's publications and information in terms of timeliness, legality, accuracy and completeness. This applies in particular if employees of vivenu act on behalf of the organiser or if the organiser uses contract documentation and templates provided by vivenu.

8.	The end customer also acknowledges that vivenu does not guarantee the uninterrupted availability or usability of the vivenu services. vivenu accepts no liability for delays or errors in transmission, memory failures and any associated restrictions to vivenu services. Please note that maintenance work may result in temporary interruptions to the website and/or individual vivenu services.

1.	Tickets may only be transferred at the price stated on the ticket. Commercial transfer (e.g. as part of a competition or for advertising purposes) is prohibited without prior written consent from the organiser or vivenu (acting on behalf of the organiser). To de-personalise personalised tickets, please contact the organiser. A processing fee may apply.

2.	If tickets are resold using the resale function provided on this website, the following conditions apply:
- The resale function is only available for tickets that have been purchased from the organiser via vivenu services (i.e. the secondary market). The organiser reserves the right to restrict or exclude the resale function for individual events, ticket types and categories, or at certain times, particularly due to the contractual requirements of partners (e.g. artists or venues) or official regulations. There is no entitlement to cancel or resell tickets.
- By placing a ticket on the secondary market, the original purchaser makes a binding declaration to return or sell the ticket to the organiser at the original ticket price (face value) or at the price determined in accordance with Section 5.2.3 ('secondary market price') as soon as another ticket is purchased on the secondary market. In the event of a successful resale, the organiser will transfer the ticket to the secondary purchaser. The original ticket issued to the initial purchaser will be cancelled or invalidated and a new ticket will be created for the secondary purchaser.
- The organiser may specify fixed prices or a price range for the resale of tickets. Additional fees may apply for resale.
- The organiser reserves the right to control the order in which tickets offered directly by the organiser and tickets offered via the resale function ('secondary market tickets') are sold. In particular, tickets that are still available may be sold before secondary market tickets are offered for sale. If there are several secondary market tickets available for the same area or category (e.g. standing blocks), the secondary market tickets offered for sale will be selected according to a non-discriminatory factor determined by the organiser. This factor will take into account the time of listing on the secondary market, among other things.
- Customers will be informed of the status of tickets offered for resale by email. In particular, the initial purchaser will receive confirmation by email once a ticket has been successfully listed on the secondary market. The initial purchaser may remove the ticket from the secondary market at any time before it is added to a secondary purchaser's shopping cart. If a ticket offered for resale does not sell (e.g. because the event has been cancelled or has expired), the initial purchaser will receive a notification to this effect.
- After a successful resale, the organiser will pay the original purchaser the secondary market price plus any fees. Payment is made in accordance with the agreed payment method.
- A ticket purchased via the resale function can be offered for resale again by the secondary purchaser, in accordance with the provisions of Section 5, via the resale function. The same terms and conditions apply as for the original purchaser.

3.	In the event of a proven violation, the organiser or vivenu (acting on behalf of the organiser) may demand payment of a contractual penalty of up to €500 per ticket from the end customer and refuse them access to the corresponding event. Further claims for damages remain unaffected by this.

6.	Revocation, cancellation, refund, return and exchange of tickets

1.	Without significant changes to the event
There is no right of revocation, return, cancellation or exchange for events, particularly services related to leisure activities, if the contract specifies a particular date or period for the provision of services, as defined in Section 312g(2) No. 9 of the German Civil Code (BGB). Any purchase of tickets is therefore binding as soon as the purchase process is complete and cannot be reversed.

2.	Significant changes, postponement or cancellation of the event
- If an event is significantly changed, postponed or cancelled due to circumstances beyond the organiser's control, the end customer is entitled to return the tickets and receive a refund of the full ticket price, including any fees paid in connection with the purchase. Refunds are usually made using the same payment method and are free of charge.
- A change is considered significant if the changed event differs fundamentally from what the ticket purchaser could reasonably have expected.

1.	Except in cases of breach of fundamental contractual obligations, injury to life, limb or health, or violations of the Product Liability Act provisions, the organiser shall only be liable for intent or gross negligence. Where there is a slightly negligent breach of essential contractual obligations, liability is limited to the value of the transaction in question. The organiser is generally not liable for damages attributable to force majeure or breaches of duty by third parties.

2.	Where the organiser's liability is excluded or limited, this exclusion or limitation shall also apply to the personal liability of the organiser's legal representatives, agents and assistants, and any other representatives acting on the organiser's behalf vis-à-vis the end customer.

3.	If vivenu acts on behalf of, or as a vicarious agent of, the organiser in relation to the end customer, or otherwise appears in relation to the end customer, the following shall apply: vivéNu shall only be liable for intent or gross negligence, except in cases of breach of any material contractual obligations, injury to life, limb or health, or in cases covered by the Product Liability Act. In the event of slightly negligent breach of essential contractual obligations, liability is limited to the transaction value associated with the transaction giving rise to liability. In principle, vivenu is not liable for damages attributable to force majeure or breaches of duty by third parties.

4.	Where liability is excluded or limited for vivenu, this exclusion or limitation shall also apply to the personal liability of vivant's legal representatives, agents and assistants, as well as any vivenu representatives vis-à-vis the end customer. In particular, vivenu shall not be liable for damages resulting from the cancellation, postponement, change, relocation or defects of an event; the insolvency of the organiser; the loss or late arrival of hard tickets; or restrictions on vivenu services.

1.	These general terms and conditions take precedence over any other provisions in the contractual relationship between the organiser and the end customer.

2.	The law of the organiser's place of business shall apply, excluding the provisions of international private law and the United Nations Convention on Contracts for the International Sale of Goods (CISG – UN Sales Convention). If the end customer is a consumer as defined by the relevant statutory provisions, the mandatory statutory provisions (particularly those relating to consumer protection) remain unaffected.

3.	If the end customer is not a consumer, the exclusive place of jurisdiction for all disputes between (i) the end customer and the organiser and (ii) the end customer and vivenu is the organiser's or vivenu's registered office, respectively.

4.	An end customer is considered a consumer if the purpose of the ordered deliveries and services is not attributable to their commercial or self-employed professional activity. Any natural or legal person or partnership with legal capacity acting in their commercial or self-employed professional capacity when concluding the contract is considered an entrepreneur. An end customer is not considered a consumer when purchasing services in connection with leisure activities if the contract specifies a particular date or period for the provision of services (within the meaning of Section 312g(2) No. 9 of the German Civil Code (BGB)).

5.	The following applies to end customers whose registered office, place of residence or habitual abode is located within the European Union:
- The end customer warrants that they have the legal capacity or powers of representation required to enter into this contract.
- The European Commission provides an online dispute resolution (ODR) platform at:
https://consumer-redress.ec.europa.eu/index_en. Neither the organiser nor vivenu are willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

6.	Should any of the above provisions be or become invalid or unenforceable in whole or in part, this shall not affect the validity of the remaining provisions. The same applies if and to the extent that a loophole becomes apparent. In place of the invalid or unenforceable provision, or to fill the loophole, an appropriate provision shall apply which comes closest to what vivenu and the end customer would have wanted, legally speaking, had they considered this point.

9. Additional provisions of the organiser

The following additional provisions of the organiser apply:

Visitors to EURO MOTO racing events must comply with the house rules of the relevant racetrack operator. These can be found at the event venue or via the links below.

Minors may only attend events when accompanied by a parent or legal guardian, or by an adult responsible for their supervision. For safety reasons, the organiser reserves the right to refuse admission to persons who are obviously under the influence of drugs or alcohol. In this case, the ticket price will not be refunded.

Visitors must follow the stewards' instructions.

Only your e-mail address is stored on mailgun's servers. The information for sending tickets, order overview, invoices and answers to support requests is used by mailgun. This is done on our behalf. mailgun may also use this data to optimize its own services. This includes in particular technical improvements and / or economic purposes, for example to determine from which countries the recipients come. mailgun does not use the purchase-related data to write to you itself or to pass on your data to third parties. We have concluded a "Data Processing Agreement" with mailgun, as we do with all processors or service providers.
